Lingofy Terms of Service

1. Introduction

Welcome to Lingofy, a service provided by New Port LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of Lingofy’s services, including our websites, applications, integrations (such as with Zoom), and related offerings (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy located at lingofy.teameet.cc/privacy. If you do not agree to these Terms, you may not use our Services.

2. Definitions

  • Account: Your registered user account on Lingofy.
  • User Content: Any data, text, voice, documents, or other materials uploaded, submitted, or shared via the Services.
  • Prepaid Plan: Purchase of translation service hours in advance.
  • Visitor: An unregistered user who can view translated sessions but cannot initiate services.

3. Your Use of Lingofy

Account Registration

You must create an Account to initiate a translation session. You must be at least 18 years old. You agree to provide accurate information and keep it updated.

Visitor Access

Visitors may join sessions and view real-time transcription and translations but cannot initiate sessions.

Prohibited Conduct

You agree not to:

  • Violate any applicable laws.
  • Use the Services for illegal or harmful activities.
  • Attempt unauthorized access to the Services.
  • Modify or remove Lingofy branding.
  • Use Lingofy in any manner that could interfere with normal operation.

Violation of these rules may result in immediate suspension or termination of your Account.

4. Payments and Refunds

Free Trial

We offer 20 minutes of free service time upon account creation.

Prepaid Service

Users purchase translation hours on a prepaid basis (in 1-hour units) via Stripe.

Refund Policy

Payments are non-refundable except where technical issues caused by Lingofy have materially impacted the service and verifiable evidence is provided.

Price Changes

We may change our prices at any time, with at least 7 days' prior notice.

5. Content and Intellectual Property

User Content

You retain ownership of your User Content. However, by using the Services, you grant us a worldwide, non-exclusive, royalty-free license to use your User Content to:

  • Provide and operate the Services.
  • Improve and train our AI models.
  • Perform internal quality assurance.

Lingofy Content

All Lingofy technology, materials, and intellectual property are owned by New Port LLC and its licensors.

6. Privacy and Data Security

Our Privacy Policy governs the collection, use, and protection of your personal information. Data is stored in the United States. We take reasonable measures to protect your data but cannot guarantee absolute security.

7. Updates and Changes to Services

We may update the Services to enhance functionality or security. We reserve the right to modify these Terms with notice via email or our platform. Continued use of Services after changes take effect constitutes acceptance of the new Terms.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the accuracy of translations or uninterrupted service.

9. Limitation of Liability

To the maximum extent permitted by law, New Port LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues.

10. Indemnification

You agree to indemnify and hold harmless New Port LLC, its affiliates, and employees from any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or your misuse of the Services.

11. Termination

We may suspend or terminate your Account immediately if you breach these Terms. You may also delete your Account at any time.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles.

Any disputes arising under these Terms shall first be submitted to binding arbitration in California. If arbitration fails to resolve the dispute, the matter may proceed to litigation in the courts of San Mateo County, California.

13. Force Majeure

We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, terrorism, government actions, labor disputes, or power failures.
